Terms of Service

1. What WhalesInsider is

WhalesInsider is an analytics and information tool. It aggregates publicly available on-chain and market data from Polymarket and related sources, and presents metrics such as whale activity, an “Insider Score”, leaderboards, arbitrage and back-tests.

We are not a broker, exchange, bookmaker, wallet, custodian, payment institution or investment adviser. We do not place, accept, match or settle any bets or trades. Any transaction you make happens on third-party platforms, at your own initiative and risk.

2. Eligibility

You must be at least 18 years old and legally permitted to use prediction markets and crypto services in your jurisdiction. You are solely responsible for ensuring that your use of the Service and of any third-party platform is lawful where you live.

3. No financial, investment or betting advice

All content in the Service is provided for informational purposes only and does not constitute financial, investment, legal, tax or betting advice, nor a recommendation, solicitation or offer to buy or sell anything.

Metrics such as the Insider Score, edge indicators, PnL and back-tests are estimates derived from historical public data. Past performance does not predict future results.

4. No guarantee of profit

We do not guarantee any profit, return, accuracy, completeness or outcome. Prediction markets are high-risk and you can lose all money you commit. You are solely responsible for your own decisions and for any losses you incur.

5. Accounts

You are responsible for keeping your login credentials secure and for all activity under your account. Notify us at [email protected] if you suspect unauthorised use.

6. Account deletion & your data

You can permanently delete your account and personal data at any time from Account settings (“Delete account”), or by contacting [email protected]. Deletion is immediate and irreversible and removes your email, login and profile data. Public on-chain prediction-market data is not personal to you and is unaffected. See our Privacy Policy for how we process data and your rights (including access, correction and erasure).

7. Subscriptions, billing and no refunds

Premium is offered as monthly, yearly and lifetime plans. Payments are processed by our third-party crypto payment provider, NOWPayments; we do not receive or store your card details or crypto keys.

All fees are payable in advance. Except where a mandatory law provides otherwise, all payments are final and non-refundable, including for unused periods, partial use, or if you stop using the Service.

Digital content and services are made available to you immediately upon payment. Where you are an EU/EEA consumer, by purchasing you expressly request immediate performance and acknowledge that you thereby lose your statutory 14-day right of withdrawal once the Service has been fully provided.

We may change plan prices going forward; changes do not affect an already-paid current period.

8. Acceptable use

You agree not to misuse the Service: no scraping beyond permitted use, reverse engineering, reselling the data, automated abuse, attempting to bypass paywalls or access controls, or using the Service for unlawful purposes.

9. Third-party platforms

The Service references and links to third-party platforms (e.g. Polymarket, NOWPayments, Google). We do not control and are not responsible for those platforms, their availability, terms or the outcome of any transaction you make there.

10. Intellectual property

The Service, its software, scoring methodology and presentation are owned by us and protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the Service for your personal, non-commercial purposes.

11. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including accuracy, fitness for a particular purpose, or uninterrupted or error-free operation.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits or trading/betting losses. Our total aggregate liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim. Nothing limits liability that cannot be limited by law, including mandatory consumer rights.

13. Changes and termination

We may modify the Service or these Terms. Material changes take effect when posted here with an updated date; continued use means acceptance. We may suspend or terminate access for breach of these Terms.

14. Governing law

These Terms are governed by the laws applicable at the operator’s place of establishment, without prejudice to the mandatory consumer-protection rights you enjoy under the laws of your country of residence, including within the EU/EEA.
